There are lots of legal and moral issues that Epstein fails to consider. A glaring one is the issue of compensating folks who live complicated lives more than others. This was brought out in the 9/11 settlement fiasco, where high-earners with wives and numerous children were compensated more than those who were gay, single or childfree.

A person who breeds and rears children in the neighborhood of tornadoes, hurricanes, volcanoes and exploding oil derricks needs to bear some of the costs, since he has put valuable things at risk.

The rule should be that damages should be paid in accordance with ex post ante assessment of the risks. No gay, single or childfree person would consider his life, together with his friends and acquaintances, worth less than that of a person who, after all, has polluted the earth with progeny whom he then subjects to great risk.
