This is just outrageous. Forget about the fairness to the individuals involved. Think about what this is going to do to how legal advice is given inside the Executive branch. One has to hope the NY Times is wrong about this. They have gotten so political lately you have to read them like some weird organ of government.

No, Mike, it's much more likely that in the future smart lawyers will simply decline to serve. And those who do serve will almost certainly pull their punches. I wish we lived in a world in which the law was always clear, and in which lawyers could be judged purely on the basis of whether they "apply the law" rather than "make stuff up." But we don't. Those who are salivating at the prospect of prosecuting errant lawyers had better think long and hard before proceeding.
